Judgment

Though a notice issued under Section 10 of the U.P. Urban Planning and Development Act, 1973 prohibiting the petitioner from raising construction is challenged, but at the time of hearing of the matter, learned counsel for the petitioner confines his relief to a direction upon the Greater Noida Authority to accord consideration to his application for sanction of construction. The map along with requisite application is stated to have been submitted on 1.4.2023. Mrs. Anjali Upadhya appearing for the Greater Noida Authority states that in the event petitioner has submitted an appropriate application for grant of permission to raise construction, the second respondent would accord consideration to it, in accordance with the applicable regulations. In view of the stand so taken, we dispose of this writ petition permitting the petitioner to approach the second respondent, annexing all relevant details along with application submitted by him, along with a certified copy of this order, within a week from today. The second respondent shall ensure that petitioner's application is examined in light of the applicable provisions, by passing a reasoned order, within a further period of six weeks, thereafter.
