learned counsel for the petitioner and Mr. K.P. Upadhyaya, learned counsel for the State. The present application is an application under section 11 (5) and (6) of the Arbitration and Conciliation Act, 1996 for appointment of the Arbitrator. I am satisfied that there exists a dispute between the petitioner and respondents. Heard Mr. K.P. Upadhyaya, Advocate, on behalf of the respondents and after being satisfied that there exists an arbitration clause, for which a notice has already been served by the petitioner and on being satisfied that the Government has not taken any step, as per my powers under section 11(5) of the Arbitration and Conciliation Act, 1996, I hereby appoint Hon. Mr. Justice A.A. Desai, the Ex. Chief Justice of this Court r/o House No. 112, Tower XI, Supreme Enclave, Mayur Vihar, Phase I, New Delhi-110091 as Arbitrator in the matter. The sole Arbitrator is requested to complete the proceedings within a period of six months. The application is disposed of accordingly. (VSS, C.J.) 04.12.2004 A
