Judgment
Operative part
The instant application is filed for condoning the delay of 161 days in preferring the connected appeal against the judgment and award dated 27.09.2012 in T.S.(MAC) No. 24 of 2010 passed by the learned Motor Accident Claims Tribunal, Khowai, West Tripura. Heard Mr. A. Das, learned counsel appearing for the appellant-applicant. Notices were issued upon the respondents and the same had been properly served. Upon receipt of the notices both the respondents entered appearance through their learned counsel, but no affidavit has been filed objecting the prayer for condonation of delay. None of the learned counsel appears when the matter is taken up today even though the names of the learned counsel for the respondents have been shown in the cause list. Considering the entire facts and circumstances and the contention made in the instant petition, it appears that the delay has been properly explained and the same is reasonable and satisfactory. Hence, the delay is condoned. The instant C. M. Application is disposed of accordingly. Download Date: 8-05-2017 16:05
