Learned counsel for the respondents submits that pursuant to notice dated 08.12.2025 (Annexure-9), the encroachment of the petitioner has already been removed. He further submits that at present, the respondents are not taking any action against the petitioner in respect of the land regarding which a Patta has been issued in the petitioner's favour and in case any further action is required for removal of encroachment or otherwise, fresh proceedings will be initiated, and due notices will be given to the petitioner prior to initiating said proceedings. In that view of the matter, the relief claimed in the writ petition has rendered infructuous.
Operative part
Accordingly, the present writ petition is dismissed as having been rendered infructuous.
However, the petitioner is at liberty to file a fresh writ petition, if need so arises.
At the same time, the petitioner is further directed not to re- encroach upon the disputed land under the teeth of this Order.
