HON'BLE MR.JUSTICE MOHAMMAD RAFIQ Shri Saransh Saini for the petitioner. Shri P.C. Sharma for the respondents. ****** The writ petition has been filed with the prayer that the petitioner be allowed to carry out the business on the site of railway station, Sikar and respondents be directed not to harass the petitioner and site enquiry should be ordered against them. Counsel for the respondent informed that for unauthorised occupying the land of the railway, already charge sheet has been filed in the railway court for offence u/s.3 of the Railways Property (Unlawful Possession) Act, 1966 and challan has been filed in that case. In the light of the fact that police has prima facie found case worth filing challan, no case is made out for interference. The petitioner should face trial in the said case.
