O R D E R S.B.CR.MISC.BAIL APPLICATION NO.188/2012. Naveen Sharma Vs. State of Rajasthan Date of order : February 2, 2012. HON'BLE MR.JUSTICE MOHAMMAD RAFIQ Shri Shailesh Kumar Panwar for the petitioner. Shri G.S. Rathore Public Prosecutor for State. ****** Contention of the learned counsel for the petitioner is that petitioner has falsely been implicated in the present case. The amount of Rs.31,645/- was recovered from co-accused Mahesh Kumar and not from the present petitioner. Otherwise also, the offence u/S.420 IPC are triable by the Magistrate of Ist Class. Challan has been filed. Trial may take long. He is ready to face the trial and there is no chance of his fleeing from justice. Learned Public Prosecutor has opposed the bail application. Without expressing any opinion on the merits of the case however considering the facts and circumstances of the case, I am inclined to enlarge the petitioner on bail u/S.439 Cr.P.C. In the result, this bail application under Section 439 Cr.P.C. is allowed and it is directed that petitioner Naveen Sharma S/o 2 SB Crlmb No.188/12. Balmukand Sharma shall be released on bail in FIR No.225/2011 registered at PS Pirawa, District Jhalawar for offence u/S.420 IPC upon his furnishing a personal bond in the sum of Rs.50,000/- together with two sureties in the sum of Rs.25,000/- each to the satisfaction of the concerned Court for his appearance before the trial court on all dates of hearing until conclusion of the trial.
