HON'BLE MR. K.S. RATHORE, J. None present for the petitioners. Mr. A.K. Sharma for the respondents. **** The petitioners are working on the post of Assistant Professor in the University of Rajasthan, Jaipur and as stated they have completed more than 15 years of service. All the petitioners are aggrieved against inaction of the respondent University and have identical grievance because of non-implementation of the Career Advancement Scheme, therefore, the present writ petition is preferred by the petitioners seeking writ, order or direction in the nature of mandamus directing the respondent University for immediately implementing the Career Advancement Scheme to the petitioners. It is stated on behalf of the respondent University that the Career Advancement Scheme is not applicable to the petitioners as they are working on (2) temporary/ad hoc basis and as per sub-clause (i) of clause-2 of the Rules for implementing Career Advancement Scheme for Assistant Professors (Lecturers) as approved by Syndicate vide Res. dated 22.08.89, the Scheme is only applicable to those Assistant Professors who have completed 8 years of service after regular appointment.

Further as per explanation given in sub- clause (iii) of Clause-2, the regular appointment and the service rendered by a teacher accordingly are defined as under for the purpose of Career Advancement- (a) Appointment as an Assistant Professor (Lecturer) in the University through Statutory Selection Committee. (b) The appointment made in the University after regular selection in continuation of the permanent service rendered by a teacher in a University or Government and/or non-government affiliated college at the time of commencement of these rules. (c) The appointment made in the University after regular selection in continuance of his/her adhoc or temporary appointment as Lecturer/Research Associate (Selected through a statutory Selection Committee for the post of Lecturer) immediately before regular selection in the University.” Thus, as per the Scheme itself, admittedly the Scheme is not applicable to those who are working on temporary/ad hoc basis and merely because they have (3) rendered service for 15 years, they are not entitled to get the benefit under the Scheme as indicated herein above. In view of the aforesaid observations, I find no merit in the writ petition. Consequently, the writ petition fails and the same is hereby dismissed. /KKC/ (K.S. RATHORE),J.
