Judgment

HON'BLE MR. GOVIND MATHUR, J. Mr. V.K. Sharma, for the petitioner/s. Mr. Rajesh Bhati for Mr. R.L. Jangid, Addl. Advocate General. ... In view of the fact that Shri Shyam Sunder Bissa, the only respondent is not holding the office of Director, Elementary Education, Rajasthan, Bikaner and is not at all presently competent to make compliance of the directions given by this Court, I am not inclined to proceed against the respondents under the Contempt of Courts Act, 1971. It is further relevant to note that at present no office of the Director, Elementary Education, Rajasthan, Bikaner exists as a consequence to establishment of Commissionerate. Having considered all these facts, this contempt petition is dismissed. However, the petitioner shall be at liberty to avail appropriate remedy against the appropriate person and the authority competent to make necessary compliance of the directions given. Sanjay/ (GOVIND MATHUR)J.
