Date of Order :: 11th August, 2008 HON'BLE MR.JUSTICE GOVIND MATHUR Mr. J.S.Bhaleria, for the petitioner. Mr. Pankaj Gupta, for the respondents. .... By this petition for writ a challenge is given to the judgment dated 22.5.2008 passed by the Non-Government Educational Institutions Tribunal, Jaipur on the count that while giving a direction for grant of leave encashment no direction is given to the State Government for grant of aid relating to the encashment in question. I do not find any substance in the argument advanced. The judgment impugned relates to grant of leave encashment to the respondent employee and that cannot be held illegal on the count that the employer has not received aid from the Government of Rajasthan. The employer institution can claim aid as per the Rajasthan Non-Government Educational Institutions Act, 1989 and the Rules framed thereunder, however, in any manner the non grant of the same have any adverse 2 effect upon the rights of the petitioner. No other ground is urged on behalf of the petitioner. Accordingly, the petition for writ is dismissed. ( GOVIND MATHUR ),J. kkm/ps.
