Jasmer Singh v. State DATE OF ORDER

Mr. S.S. Dhilon, for the petitioner. Mr. A.R. Nikub, Public Prosecutor for the State. The contention of the present petitioner that he has been involved falsely. In the FIR, the complainant has alleged against Rai Sahab, Jakir Hussain and Daya Ram, who have induced the complainant to invest the money. There is no allegation of inducement against the present petitioner. No specific roll has been assigned to the present petitioner and the co-accused Hardev Sharma has been released on bail. The learned public prosecutor has opposed the bail application and submitted that there are specific allegation against the present petitioner. Other cases are also pending against the present petitioner and the present petitioner is the main conspirator in the offence. Looking at the above and the fact that the similarly situated person has already been released on bail, it is a fit case to release the present petitioner on bail. Accordingly, the bail application is allowed and it is directed that petitioner Jasmer Singh s/o Suraj Bhan in connection with FIR No. 37/2010 of Police Station Bhanipura shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- along with two sound and solvent sureties of Rs.25,000/- each to the satisfaction of the trial court for his appearance before that court on the next date of hearing and on subsequent dates whenever called upon to do so. mlt/35 [Nisha Gupta],J
