Judgment

Operative part

Mr. Pradeep Shah, for the petitioners. Mr. Anil Joshi, Public Prosecutor for the State. Mr. L.D. Khatri for the complainant The contention of the present petitioners is that there is no iota of evidence against the present petitioners that they had, in any manner, abetted Sakina to commit suicide. It has come on record that Same Khan was having illicit relations with the deceased and he has threatened her which had led her to commit suicide. The contention of the learned public prosecutor is that the present petitioners were having illicit relations which each other and the deceased had used to object it. Due to this they had pressurised and threatened Sakina which lead her to commit suicide and he has drawn my attention towards the statement of Sawai Khan and Smt. Sumi. The witnesses Sawai Khan and Smt. Sumi have stated that the present petitioners were having illicit relations and the deceased has used to object it. On the contrary it has also been stated that the deceased was having illicit relation with one other person Samme Khan and Samme Khan had used to pressurise and threatened the deceased, which led her to commit suicide. Without going into the merit of the case and looking at the above, it is a fit case to release the present petitioners on bail. Accordingly, the bail application is allowed and it is directed that petitioners Smt. Sua w/o Aju Khan and Ishk Khan s/o Bhikhe Khan in connection with FIR No.37/2011 of Police Station Falsund Tehsil Pokaran District Jaisalmer shall be released on bail provided each of them furnishes a personal bond in the sum of Rs.30,000/- along with two sound and solvent sureties of Rs.15,000/- each to the satisfaction of the trial court for their appearance before that court on the next date of hearing and on subsequent dates whenever called upon to do so. mlt/108 [Nisha Gupta],J
