HON'BLE MR. GOVIND MATHUR, J. Dr. P.S. Bhati, for the petitioners. Mr. M.R. Singhvi, for the respondents No.2 and 3. At the threshold, it is stated by the learned counsel for the respondents No.2 and 3 that if this Court accepts this petition for writ as prayed for, the answering respondents are having no objection. In view of the statement given and also looking to the relevant aspects of the matter, I am of the view that the petitioners were required to be heard by the Commissioner, Devasthan while undertaking proceedings as per Section 23 of the Rajasthan Public Trust Act, 1959. Accordingly, this petition for writ is allowed. The order dated 22.10.2007 (Annex.-8) is set-aside. The application preferred by the petitioners as per provisions of Order 1 Rule 9 and Order 31 Rule 2 of the Code of 2 Civil Procedure dated 3.9.2007 is allowed. The petitioners are impleaded as party to the proceedings concerned. The Commissioner, Devasthan is directed to heard the matter afresh by giving an opportunity of hearing to the petitioners also. Looking to the nature of the dispute, the Commissioner, Devasthan is further directed to decide the dispute expeditiously as far as possible within a period of three months from today. Counsel for the parties are agreed to appear before the Commissioner, Devasthan on 2.8.2010. RM/ (GOVIND MATHUR)J.
