Operative part
HON'BLE MR.JUSTICE H.R. PANWAR Mr.Sanjay Mathur, for the petitioner. The petitioner has assailed the order issuing process dated 03rd May, 2005 passed by the Judicial Magistrate No.4, Bikaner. I have heard learned counsel for the petitioner. The order issuing process is an interlocutory order and is therefore, not revisable. I am fortified with my view by decision of three Judge Bench of Hon'ble Supreme Court in Adalat Prasad vs. Rooplal Jindal & Ors., JT 2004 (7) SC, 243 and in Subramanim Sethuraman vs. State of Maharastra & Anr. 2004 CRI.L.J. 4609. In these circumstances, the order impugned is not revisable and, therefore, the revision petition stands dismissed. [H.R. PANWAR],J. Ashwini/-
