HON'BLE MR. GOVIND MATHUR, J. Mr. Vijay Aggarwal for the petitioner. Mr. J.S. Bhaleria Sankhala for the respondents. The Rajasthan Non-Government Educational Institutions Tribunal, Jaipur by its judgment dated 06.09.2001 accepted an application preferred by the petitioner under Section 21 of the Rajasthan Non-Government Educational Institutions Act, 2001. A petition for writ giving challenge to the order aforesaid also came to be rejected on 30.08.2005. By alleging non-execution of the directions given by the Tribunal, this application is preferred to initiate proceedings under Contempt of the Courts Act, 1971, against the respondent, who is Secretary, Management Committee Gramothan Vidhyapeeth, Sangaria. As a matter of fact, whatever directions given in favour of the petitioner, that was by the Rajasthan Non- Government Educational Institutions Tribunal, Jaipur and this 2 Court while rejecting the writ petition preferred by the Management of the School concerned, affirmed the judgment passed by the Tribunal. The petitioner, therefore, can get adequate relief by initiating execution proceedings under the Rajasthan Non-Government Educational Institutions Act, 1989 itself. In view of it, I do not consider it appropriate to entertain this application and to proceed against the respondents under Contempt of the Courts Act, 1971.
