(Oral) Since all these contempt p mpt petitions have been filed alleging vi ing violation of the common order da rder dated 14.02.2022 (Annexure P-1) passed passed by the Division Bench of this f this Court in CWP-20384-2021 titled as “P as “Pradeep Kumar vs. State of Hary f Haryana and others”, the same are being d eing decided by way of this common o mon order. Vide order dated 14.02.2022

2.2022 (Annexure P-1), it was directed as ted as under:-

Keeping n view in v the above detailed proposed plan and the the interest of the land owners, a direction is being iss g issued that all the executing Courts in the State of H of Haryana are restrained from taking any coercive step steps, as the respondents have carved out a plan for d or depositing the compensation amount and the Refere ference Courts will accept the compensation as per per the above said proposed plan. Learned couns ounsel for respondent-HSVP further informs that du t due publication will be made with respect to the pro proposed plan for depositing compensation througho ughout the State of Haryana so that the land owners ers may be made aware with respect to the deposit o sit of compensation as per the schedule stated above. ove. Learned counsel for the resp e respondents contends that the petitioners ioners herein were not parties to CWP CWP-20384-2021, nor did they file any wr ny writ petition. It is further submit submitted that CWP-20384-2021 was dispos disposed of as rendered infructuous, v ous, vide order dated 02.5.2024, as the co he compensation amount was disb disbursed to the land losers concerned. erned. He further contends that som at some persons challenged the order dated r dated 14.2.2022 passed in CWP- -20384-2021 before Hon’ble Supreme C eme Court in SLP(C) No.4832 of 20 of 2022, which was disposed of vide order d order dated 31.10.2023. The relevant portion of the ord the order dated 31.10.2023 passed by Hon’bl on’ble the Supreme Court in SLP n SLP(C) No.4832 of 2022 is reproduced duced as under :- "In so far as th s the remaining land-loosers, where the payment has has not been made, we clarify that the restraint imp imposed by the High Court through the order dat dated 14.02.2022 to proceed with the execution sha shall stand vacated and the land-loosers will be be entitled to initiate such proceedings including ing execution proceedings for unt. recovery of the amount.

Needless to men mention since the land-loosers are still agitating their eir rights to seek for receiving the compensation in res n respect of the land which have been lost by them, the e the executing courts as well as the other courts where ere the proceedings have been initiated, shall keep in ep in view this aspect of the matter and proceed ceed with the matters as expeditiously as possibl ssible.
