(Oral) The petitioner claims itself to be a welfare organization known as 'Shamshan GhaT Sudhar Committee. The grievance of the petitioner- Committee is that the shamlet deh duly vested in the Gram Panchayat and earmarked for common purpose is being encroached upon by the land grabbers and an order dated 7.9.2010 (Annexure P-2) is unfortunately passed in their favour by the District Development and Panchayat Officer- cum-Collector, Panchayat Lands, Shaheed Bhagat Singh Nagar under Section 7 of the Punjab Village Common Lands Act, 1961 but the Gram Panchayat or any other competent authority are not taking any decision to file an appeal against the same. CWP No.8600 of 2011 [2] Having heard learned counsel for the petitioner and without going into the merits of the allegations levelled, I deem it appropriate to dispose of this writ petition with a direction to respondent No.2 to intervene in the matter and issue appropriate instructions to challenge the order dated 7.9.2010 (Annexure P-2) if respondent No.2 is of the bonafide opinion that the said order is per se illegal. An appropriate decision in this regard shall be taken within a period of two weeks from the date of receiving a certified copy of this order. Ordered accordingly. Dasti.
