(Oral) The petitioner-Assistant Provident Fund Commissioner, Gurgaon is aggrieved by the order dated 23rd March, 2011 (Annexure P-3) passed by the Employees Provident Fund Appellate Tribunal, New Delhi whereby the petitioner's order dated 30.4.2009 passed under Section 7A of the Employees Provident Fund and Miscellaneous Provisions Act, 1952 (hereinafter referred to as 'the Act') has been set-aside on the premise that under Section 2 (b) of the Act, the House Rent Allowance is to be excluded from the 'Basic Wages”. No exception can be taken to the view taken by the Appellate Tribunal. The Division Bench of this Court in LPA No.1139 of 2011 CWP No.21898 of 2011 [2] (Assistant Provident Fund Commissioner versus M/s G4S Security Services (India) Limited and another, decided on 20.7.2011, has also taken a similar view.
