(i) The respondent No.1 shall give opportunity of hearing to the appellant.

(ii) The appellant is directed to appear before the respondent No.1 on 30th April, 2007. In view of the above, the Civil Suit No.7/2006/II, pending in the Court of IInd Addl. District Judge, South Goa, Margao stands withdrawn. Pending decision on the application under Section 7-A(4) of Employees Provident Fund and Miscellaneous Provisions Act, 1952, the respondent No.1 shall not proceed with the prosecution of the appeal. The appeal stands disposed of in the above terms. ssm. S.A.BOBDE, J.
