(ORAL) Learned State counsel has referred to order passed in Criminal Appeal No. 386-SBA of 2002 which reads thus: “On the last date of hearing, following order was passed in this case:-
Learned State counsel, on instructions from HC-kaur Singh of Police Station Badali Ala Singh, submits that accused Jaswinder Singh has since expired. He has place on record a death certificate in support of his submission. Learned State counsel further submits that an affidavit of the SHO of concerned Police Station shall also be filed in this regard before the next date of hearing. To come up on 31.03.2010.
Learned State counsel submits that the factum of death of respondent/accused Jaswinder Singh son of Ram Saroop has been verified from the concerned Police Station. She has placed on record an affidavit of Bhupinder Singh, SHO Police Station Bassi Pathanan, Criminal Revision No. 577 of 2002 2 District Fatehgarh Sahib in this regard. The factual submission is not disputed by the learned counsel appearing for the respondent/accused. In view of the above, this petition is dismissed as abated.” She submits that in view of the above order, this petition preferred by the complainant is also deemed to have abated.
