(Oral) 1 This petition has been filed under Section 482, Code of Criminal Procedure, praying for issuance of directions to respondents No.1 to 3 to take action against respondent No.4, who has misused his official position and has given false information to the passport office. 2 It has been pleaded that the petitioner applied for issuance of a passport. Although the petitioner was acquitted of the charges and respondent No.4 was aware of the said fact, a false report was made to the passport office, on account of which there has been considerable delay in issuance of passport of the petitioner. 3 Reply by way of affidavit of Shri Rakesh Aggarwal, IPS, Senior Superintendent of Police, Hoshiarpur, has been filed in Criminal Misc. No.23468 -M of 2011 (O&M) 2 Court today, which is taken on record. 4 As per the reply, the allegations made by the petitioner have been found to be genuine. After preliminary inquiry, regular departmental inquiry has been ordered against Inspector Sukhjinder Singh and Head Constable Jagdeep Singh. This court has been assured by the Senior Superintendent of Police, Hoshiarpur, in the reply, that further action would be taken, as per the outcome of the departmental inquiry. 5 Learned counsel for the respondent-State has informed the court that passport has already been issued to the petitioner. 6 In view of the stand of the respondent-State, no further orders need be passed. 7 The petition is, accordingly, disposed of.
