Learned counsel for the petitioner su Lear oner submits that petitioner had filed nomination pape papers for the post of Sarpanch, Gr ch, Gram Panchayat, Village Latian Wala, Tehsil Sul sil Sultanpur Lodhi, District Kapurtha a purthala well in time, however, in a notice was issue issued by respondent No.6, against gainst petitioner, an objection was stated to be rai be raised, however, no reason for t n by for the same has been given by respondent No.6 t No.6. The petitioner has made repr 2024 representations dated 29.10.2024 (Annexures P-2 2 and P-3) qua his grievance, ho ce, however, the same has not been adverted to till da till date. On the other hand, on advance service of copy of petition, learned State counsel appears and opposes issuance of notice of motion. He submits that now the election to the post of Sarpanch of the concerned village has been over, and in case, the petitioner has any grievance qua the same, he may file an election petition in terms of Sections 74 and 76 of the Punjab State Election Commission Act, 1994 (for short ‘Act of 1994’) before the competent authority.
At this stage, learned counsel for the petitioner submits that the petitioner be permitted to withdraw the present writ petition with liberty to file election petition in accordance with law.
