(Oral) : Suit filed by plaintiff-respondent regarding pension as ex- serviceman has been decreed by the trial court. First appeal preferred by the defendants has been dismissed as time barred by the Lower Appellate Court, vide judgment dated 08.05.2009, which is under challenge in the instant revision petition preferred by defendants under Article 227 of the Constitution of India. The matter involved in the instant revision petition relating to grant of pension is covered by Section 34 and Section 35 of the Armed Forces Tribunal Act, 2007 and therefore, in view of said provisions, the instant revision petition has to be transferred to the Armed Forces Tribunal, Chandimandir Bench and is accordingly transferred to the said Tribunal for C. R. No. 5263 of 2009 2 disposal in accordance with law. Records of the revision petition be sent by the Registry to the said Tribunal immediately. Parties are directed to appear before the Tribunal on
