Present: Mr. Kunal Dawar, Advocate for the petitioner. ..... SABINA, J. Respondents No. 1 and 2 have filed a suit for declaration with consequential relief of permanent injunction. Defendant No.1- respondent No.3 has moved an application under Order 7 Rule 11 of the Code of Civil Procedure. Plaintiffs have moved an application under Order 6 Rule 17 of the Code of Civil Procedure. Learned counsel for the petitioner-defendant No.2 has submitted that the suit was filed by the plaintiff in the year 2006 and the application under Order 7 Rule 11 of the Code of Civil Procedure was moved on 8.7.2006 but till date the same has not been disposed of. Accordingly, this petition is disposed of with the direction to the trail court to dispose of the application moved under Order 7 Rule 11 of the Code of Civil Procedure, expeditiously, preferably on the date fixed i.e. 2.6.2011.
