It is submitted by counsel for the appellant that the Commercial Court has rejected the application under Section 9 of the Arbitration and Conciliation Act, 1996 (for short, 'the Act') primarily based on provisions of Section 69(2) of the Indian Partnership Act, 1932 (for short, 'the Act, 1932') whereas the present application under Section 9 of the Act was filed by the appellant as an individual and even otherwise, he is not partner of the partnership firm but a limited liability partnership in the name of Shree Madhuraj Alloys LLP to which provisions of the Act, 1932, has no application.
In view of the submissions made, issue notice to the respondents returnable on 29.04.2026. March 26, 2026 Sandeep/AKShukla (Kshitij Shailendra,J.) (Arun Bhansali, CJ.)
