It is argued by learned counsel for the petitioners that an ex-parte order dated 28.06.2017 was passed against the petitioner by which Case No.101/268 of 2011 (Heera Lal Vs. State) under Section 41 of U.P. Land Revenue Act, 1901 filed by the petitioner has been dismissed in default. Aggrieved with the aforesaid, a restoration application has been filed by the petitioner on 08.02.2017, copy of the same is appended at Page 48 of the Paperbook. It is argued that more than eight years have been lapsed but till date no decision has been taken in the matter.

It is unfortunate that the restoration application filed by the petitioner are pending consideration for more than eight years.

In this view of the matter, learned Standing Counsel is directed to seek Instructions in the matter from respondent No.2/Sub Divisional Officer, Chunar District Mirzapur within two weeks from today faling which he shall remain present before the Court on the next date fixed in the matter, i.e., on 17.02.2026.

Put up as fresh on 17.02.2026. 2 WRIC No. 1417 of 2026

Registrar (Compliance) is directed to communicate a copy of this order to respondent No.2/Sub Divisional Officer, Chunar District Mirzapur through District Magistrate, Mirzapur within 48 hours. January 20, 2026 saqlain (Prakash Padia,J.)
