Heard Sri Dinesh Kumar Singh, learned counsel for the applicants, learned counsel for the State of U.P. and perused the records.

The instant application under Section 528 B.N.S.S. has been filed by the applicants with a prayer to quash the entire proceedings of Case No. 8384 of 2025 (State vs. Manish Agarwal and othes) based on charge sheet dated 05.12.2024 arising out of Case Crime no. 154 of 2024, under Sections 115(1), 352, 351(2), 85 B.N.S. and Section 3/4 D.P. Act, Police Station Pipri, District Sonbhadra, pending in the court of Civil Judge (Junior Division) /FTC / CAW, Sonbhadra including the cognizance order dated 02.08.2025.

Learned counsel for the applicants contended that the applicants are the in laws of opposite party no. 2. He further contended that the allegation levelled against the applicants are wholly false and vague. No specific allegation has been levelled against them. During the course of argument, learned counsel for the applicants had placed reliance on the judgment of the Apex Court in the case of Geeta Mehrotra Vs. State of U.P. and others reported in 2012 (10) ADJ 464 and Kahkashan Kausar @ Sonam and others vs. State of Bihar and others, (2022) 6 SCC 599.

Issue notice to the opposite party no. 2, returnable at an early date.

Notice on behalf of the State of U.P./Opposite Party No. 1 has been 2 NA528 No. 50898 of 2025 accepted by the learned counsel for the State.

Opposite parties may file their respective counter affidavit, if any, within four weeks. Rejoinder affidavit, if any, may be filed within two weeks thereafter.

List this case after six weeks.
