This application has been filed by applicants for quashing the entire proceedings of Case No.11679 of 2020 arising out of Case Crime No.122 of 2019 (State Vs. Nitesh Singh & others), under Sections 498A, 323, 504, 506 Indian Penal Code and Section 3/4 Dowry Prohibition Act, Police station- Mahila Thana, District- Ghaziabad including Charge Sheet dated-09.02.2020, cognizance order and summoning order dated 22.07.2020 dated 16.04.2025 passed by Additional Chief Judicial Magistrate, Court No. 8, Ghaziabad.
Learned counsel for the applicant submits that applicants are mother-in-law and maternal father-in-law. He submits that vague and general allegation with regard to demand of dowry has been made. He submits that there is no specific allegation and the matter is covered by the judgments of Supreme Court in Geeta Mehrotra Vs. State of U.P. and others reported in 2012 (10) ADJ 464 and Kahkashan Kausar @ Sonam and others vs. State of Bihar and others, (2022) 6 SCC 599.
Matter requires consideration.
