Judgment

Heard learned counsel for the applicants and learned A.G.A. for the State.

The present 528 B.N.S.S. application has been filed to quash the charge-sheet dated

15.06.2024, cognizance/summoning order dated 18.07.2024 as well as entire proceedings of Criminal Case No.29417 of 2024 (State vs. Gagandeep and others ) arising out of Case Crime No.0959 of 2023, under sections 498-A, 323, 506 I.P.C. & Section 3, 4 Dowry Prohibition Act, Police Station Civil Lines, District Moradabad, pending before the court of Additional J.S.C.C./A.C.J.M. Moradabad on the basis of compromise dated 11.01.2025.

Learned counsel for the applicants submits that the applicant no.1 is husband of opposite party no.2 and both are living separately. Learned counsel for the applicants next submits that the applicant no.1 and opposite party no.2 have amicably settled their dispute out of court and entered into compromise and same is filed before the court concerned. Opposite party no.2 and applicant no.1 have also filed their mutual divorce petition under section 13(B) of the Hindu Marriage Act, 1955 which is pending before Family Court, Moradabad. 11.01.2025 entered between the parties has been annexed as Annexure 3 to the application.

Learned AGA has accepted notice on behalf of opposite party no.1.

Issue notice to opposite party no.2 returnable at an early date.

Accordingly, it is provided that the parties shall appear before the court below alongwith a certified copy of this order and photocopy of the compromise deed for verification of the parties within a period of six weeks. The trial court is directed to verify the parties and thereafter, the court shall transmit the verification report to this Court within a period of two weeks. 2 NA528 No. 44702 of 2025
