Challenge in the writ petition is to a notice issued to the petitioner on 01.04.2025 calling upon the petitioner to remove his unauthorized construction failing which proceedings under the U.P. Municipalities Act 1916 shall be drawn against him. It is submitted by learned counsel for the petitioner that a detailed reply has been submitted by the petitioner to this notice on 14.04.2025. Counsel appearing for the respondent has stated that no such reply is available in the record of the respondent. The petition is also silent as to the manner in which this reply was furnished to the respondents. Be that as it may, the objection of the petitioner is appended with the writ petition as Annexure No.3. The petition under the circumstances is disposed of directing the respondent to consider also this reply filed by the petitioner before proceedings any further in the matter.
