It is submitted by learned counsel for petitioner that the petitioner was contractor. An accident took place where nine workmen has died. The principal employer respondent no.6 and the petitioner had paid a sum of Rs.25 lakhs per employee as compensation which was received by claimants. Subsequently, the proceedings under the Employees Compensation Act, 1923 has been initiated. The compensation which has been fixed by the impugned order is less than Rs.25 lakhs which has already been received. The only objection to the effect is that once the amount i.e. Rs.25 lakhs each received by the family members of the employees, then there is no occasion for making any further payment even if, the compensation decided under the Employees Compensation Act, 1923 and the aforesaid amount has already been paid is required to be adjusted.

Issue notice to respondent nos. 6 to 15.

Steps be taken within 10 days.

The respondents may file their counter affidavits within three weeks.

List on 11.04.2025.
