The challenge raised in this Writ Petition is to aninterim order dated 20th December 2024 passed by the Maharashtra Administrative Tribunal, Mumbai (‘Tribunal’) in fourOriginal Applications preferred by the Petitioners. The Petitionerswere seeking age relaxation for participating in the recruitmentprocess, by virtue of Government Resolution dated 3rd March2023. The Tribunal refused to grant any interim relief. Aggrievedthereby, the Petitioners have approached this Court.

We find that as a challenge has been raised to aninterlocutory order, it would be fitness of the things that the Gaikwad RD 1/3 12-wp-19377-2024.docOriginal Applications pending before the MaharashtraAdministrative Tribunal are decided finally on merits. This wouldenable the Petitioners to be aware of the position as to whetherthey are entitled to participate in the recruitment process or not, on the basis of their prayer for grant of age relaxation.

In view of the aforesaid, the following order is passed:ORDER(i)Original Application Nos.1160 of 2024, 1232 of 2023,1245 of 2024, 1183 of 2024 and MiscellaneousApplication Nos.472 of 2024, 593 of 2024 & 492 of 2024that are pending before the Maharashtra AdministrativeTribunal shall be decided expeditiously and preferably bythe end of September 2025.(ii)It is clarified that all contentions of the parties are keptopen. The Tribunal shall not be influenced by theobservations made in its interim order dated 20thDecember 2024 and all contentions be considered ontheir own merits.
