This matter taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioners and learned counsel for the State. The present Writ Petition has been filed with the following prayer:-
It is therefore prayed that this Hon’ble Court may graciously be pleased to admit this writ petition issue notice to the Opp. Parties call for the records and after hearing the parties issue writ/writs in the nature of mandamus/certiorari or any other writ direct the Opp. Party No.3 to refer the objection dated 20.10.2022 of the petitioner to the authority for determination of the amount of compensation Under Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation Resettlement Act, 2013, vide Annexure-4 by the petitioners within a stipulated period for the interest of justice; And the Hon’ble Court may pass any order/direction may be deem fit and proper. And for this act of kindness the petitioner shall as in duty bound ever pray.
In course of hearing, learned counsel for the Petitioners states that highlighting their grievances, the Petitioners have made objection to Opposite Party No.3 vide Annexure-4 and the same may be directed to be considered within a stipulated time, to which learned Counsel for the State has no objection. As agreed by learned counsel for the parties and after going through the records, this Court, without expressing any opinion on the merits of the case, disposes of the Writ Petition directing Opposite Party No.3 to consider the objection filed by the Petitioners vide Annexure-4, and pass appropriate order accordance with law within a period of two months from the date of production of certified copy of this order.
