2. This matter is taken up through hybrid mode.
Order dated 14th August, 2024 (Annexure-4) passed in I.A. No. 48 of 2024 (arising out of Execution Case No.1 of 2011) is under challenge in this CMP, whereby learned Civil Judge (Senior Division), Angul rejected an application filed by the Petitioner to stay further proceedings of the execution case during pendency of the I.A. filed under Order XXI Rule 97 C.P.C.
In course of hearing, Mr. Baug, learned counsel for the Petitioner prays for withdrawal of the CMP.
Mr. Mohapatra, learned counsel for Opposite Parties does not have any objection to the same.
