The petitioner has filed this writ petition with the following prayer:
In the aforesaid facts and circumstances, it is humbly prayed that the Hon'ble Court may be pleased to issue Rule NISI calling upon the opposite parties to show cause as to why the prayer of the Petitioner for payment of compensation under The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 by acquiring the land at Annexure -1 for public purpose should not be granted and if the Opposite Parties fail to show cause or show insufficient cause then make the Rule absolute and issue a writ of mandamus directing the opposite parties to award compensation as due and admissible under the The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 read with The Odisha Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Rules 2015 to the Petitioner and her son and daughter by formally acquiring the land for public purpose as detailed in ROR at Annexure-1 and issue any other Writ (s) and pass any other Order(s) as may be deemed fit and proper and for this act of kindness the petitioner shall remain pray.
In course of hearing, learned counsel appearing for the petitioner states that the petitioner has already made representation before Opposite Party No.3 vide Annexure-3, and the same may be directed to be disposed of within a stipulated time, to which learned Counsel for the State has no objection.
As agreed by learned counsel for the parties and after going through the records, this Court, without expressing any opinion on the merits of the case, disposes of the Writ Petition directing Opposite Party No.3 to consider and dispose of the representation filed by the petitioner vide Annexure-3 and pass appropriate order as early as possible within a period of three months from the date of production of certified copy of this order.
