ORDER 21.04.2026 Heard learned counsel for the Petitioners and learned counsel for the State.
The Petitioners are seeking pre-arrest bail in connection with G.R. Case No.76 of 2026 pending on the file of learned J.M.F.C., Tangi arising out of Nirakarpur P.S. Case No.28 of 2026 for commission of offences punishable under Sections 115(2)/ 296/ 351(3)/ 303(2)/ 3(5) of BNS.
Learned counsel for the State opposes the prayer.
Taking into account the nature of allegations and the punishment prescribed, this Court has no iota of doubt investigating agency shall scrupulously follow the guidelines laid down by the Apex Court in the case of Arnesh Kumar vrs. State of Bihar & another, (2014) 8 SCC 273 and reiterated in the case of Satender Kumar Antil vrs. Central Bureau of Investigation & another, (2022) 10 SCC 51.
