Heard learned counsel for the Petitioner and ORDER 15.04.2025 learned counsel for the State.
The Petitioner is seeking pre-arrest bail in connection with C.T. Case No.657 of 2024 pending on the file of learned J.M.F.C., Jaleswar arising out of Raibania P.S. Case No.138 of 2024 for commission of offences punishable Sections 137(2)/127(2)/296/115(2)/74/351(2)/351(3)/3(5) of BNS.
Learned counsel for the State opposes the prayer.
Considering the submission of the learned counsel for the Petitioner that the Petitioner has no criminal proclivity and taking into account the case and counter case and the punishment prescribed for the alleged offences, this Court has no iota of doubt that the authority shall scrupulously follow the guidelines laid down by the Apex Court in the case of Arnesh Kumar vrs. State of Bihar & another, (2014) 8 SCC 273 and reiterated in the case of Satender Kumar Antil vrs. Central Bureau of Investigation & another, (2022) 10 SCC 51.
