Heard learned counsel for the Petitioner and learned counsel for the State.
The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.728 of 2025 pending on the file of learned JMFC(P), Kujang, arising out of Kujang P.S. Case No.287 of 2025 for commission of offences punishable under Sections 316(4)/ 318(4) of BNS, 2023.
Learned counsel for the State opposes the prayer.
Considering the nature of allegations, punishment prescribed, this Court has no iota of Investigating Agency scrupulously follow the guidelines laid down by the Apex Court in the case of Arnesh Kumar vrs. State of Bihar & another, (2014) 8 SCC 273 and reiterated in the case of Satender Kumar Antil vrs. Central Bureau of Investigation & another, reported in (2022) 10 SCC 51.
