This matter is taken up through hybrid arrangement.

Heard learned counsel for the Petitioner and the learned counsel for the State.

According to learned counsel for the Petitioner, the grievance of the Petitioner in this case is that the in spite of direction of the learned J.M.F.C.(R), Balasore to register the complaint of the petitioner against the opposite party No.5, the opposite party No.4/ IIC, Balsore Sadar Police Station is not taking any steps to register it. Further, As no action has been taken by the said opposite party the petitioner submitted the grievance petition before the Superintendent of Police, Balasore on

13.01.2023 under Annexure-2 Series. However, the F.I.R. has not been registered. In such background, he prays // 2 // that necessary direction be given to the opposite party No.4 to register the case if cognizable offence is made out.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs the I.I.C., Balasore Sadar Police Station to take a decision on the written report under Annexure-1 keeping in mind the decision of the Supreme Court in the case of Lalita Kumari v. Govt. of U.P. & Others1 within a period of four weeks from the date of production of certified copy of this order, if cognizable offence is made out.

Accordingly, this CRLMP is disposed of.
