It therefore humbly prayed Hon’ble Court may graciously be pleased to admit the writ petition, issue rule nisi calling upon the Opp. Party to show cause as to why the prayer of petitioner shall not be allowed and as to why appropriate order shall not be passed to The Learned Debt Recovery Tribunal Cuttack for early disposal of the S.A. No.236 of 2023, pending before the Debt Recovery Tribunal, Cuttack; And in the event the Opp. Party(ies) file(s) no show cause or file(s) insufficient or false cause the Hon’ble court may be pleased to make the rule nisi absolute; And/or may pass any other writ/writs, order/orders, direction/directions as this Hon’ble court may deem fit and proper;

Learned counsel for the Petitioner submits that right to speedy remedy is a facet of Article 21 of the Constitution of India and therefore, the long pendency of her S.A. No.236 of 2023 on the file of the D.R.T., Cuttack militates against the right. We broadly agree with this.

Notice to other side is dispensed with, since no coercive order is being made against them. Even otherwise, they can seek recall of this order, if grounds do exist therefor. In the above circumstances, Writ Petition is disposed off requesting the Presiding Officer of the D.R.T., Cuttack to hear and dispose off the subject S.A. as early as possible and in accordance with law. Registry to send a copy of this order to the OP-Bank by speed post immediately.
