27.11.2023 [1] Heard Mr. Ng. Jagatchandra, learned counsel for the petitioner and Mrs. Ch. Sundari, learned GA for the State Respondents. [2] By the present petition, the petitioner approached this Court for appointing him under Die-in-Harness Scheme in place of his mother who died during service in the office of Executive Engineer, Thoubal P.H.E. Division, PHED, Manipur. [3] Mr. Ng. Jagatchandra, learned counsel for the petitioner draws the attention of this Court to Annexure-A/3, letter dated 09.04.2015 sent by the Executive Engineer, Thoubal PHE Division, PHED, Manipur to the Chief Engineer, Public Health Engineering Department, Manipur for considering the case of the petitioner for appointment under Die-in- Harness Scheme and necessary documents were also annexed with this letter. [4] Mr. Ng. Jagatchandra, learned counsel for the petitioner submits that the present petition may be disposed of by passing a direction to the respondents to consider the case of the petitioner under Die-in-Harness Scheme as per her seniority list as maintained by the respondents. [5] Mrs. Ch. Sundari, learned GA for the State Respondents is agreeable to the submission made by the learned counsel for the petitioner. [6] With this observation, the writ petition is disposed of with a direction to respondent No.1, Principal Secretary/ Commissioner, Public Health Engineering Department, Government of Manipur & respondent No.2, Chief Engineer, Public Health Engineering Department, Government of Manipur, to consider the case of the petitioner in terms of Annexure- A/3 as per the Scheme and her seniority list as maintained by the respondents. [7] It is made clear that this Court has not expressed any opinion on the merit of the case. [8] Furnish a copy of this order to the learned counsels appearing for the parties. - Larson JUDGE
