ANTONY DOMINIC,J----------------------------------W.P.(C)No.33977 of 2008-------------------------------------Dated this the 27th day of June, 2012 JUDGMENTPetitioner approached this Court mainly challenging inactionon the part of the Panchayath in implementing its decision asreflected in Ext.P5. Ext.P5 is a communication issued by the firstrespondent requiring the second respondent to demolish andremove certain constructions, which were made in violation of Section 220(b) of the Kerala Panchayath Raj Act, 1994. Despite service of notice, the second respondent has notchosen to enter appearance or file a counter affidavit. Once Ext.P5 has been issued, unless the same is stayed orset aside by any superior authority, Panchayath is bound toimplement the same. Therefore, it is directed that if Ext.P5 stillremains in force the Panchayath will ensure that the same isimplemented. This shall be done as expeditiously as possible onthe production of a copy of this judgment. Writ petition is disposed of as above. ANTONY DOMINIC, JUDGEln
