The award of the Labour Court was modified by this Court. But that does not take away the jurisdiction of the Labour Courtto entertain a petition under Section 33(C) (2) of the IndustrialDisputes Act, 1947. Having regard to the peculiar facts andcircumstances of the case, this writ petition is disposed ofwithout prejudice to such right of the petitioner to have recourseto such remedy. If the petitioner makes a proper request beforethe Labour Court for an expeditious disposal, having regard tothe facts and circumstances of the case that the petitioner is notin service from 1994, the Labour Court will consider that requestsympathetically.
