No.27/2009 dated Judge (Sr.Dn.), Karwar 07.09.20 10 wherein the Court has granted decree of divorce on the petition filed by Respondent/wife. The court below has directed the appellant herein to pay permanent alimony of Rs.5,00,000/- [Rupees Flue Lakhs only. This order is challenged.
Today. both parties have filed a joint memo which is signed by the appellant and respondent and their respective counsel. Both parties are present before the Court. They admit the execution of the joint memo. Their respective advocates have identified the parties.
The joint memo is taken on record.
According to the joint memo, the appellant has no objection for confirmation of decree of divorce :3: granted by the court below. However, the parties have agreed to reduce the permanent alimony granted by the to Rs.3,00,000/- below from Rs.5,00,000/- (Rupees Three Lakhs only.
The appellant has agreed to pay the amount of [Rupees Three Lakhs only towards Rs.3,00,000/- permanent alimony within six months from today. Accordingly, the appeal is dismissed with the above modifications. If the amount of Rs.3,00,000/- is not paid within the order of the trial court six months from today, stands confirmed.
