The learned counsel for the appellant, the learned counsel second respondent representative are present.

After due deliberation in the matter, have arrived at a settlement. The second Respondent has agreed to nan a sum of 6OOOO / - I Rupees Sixty Thousand on.ly) without interest, in addition to the. amount tureadv awarded b the Tribunal. The Appellant has agreed to receive the said amount in fu.l1 and final settlement of the claim. Joe secotto respondent Has agreea to deposit the amount before the. Tribunal within six weeks from I t 3 the date of preparation of the award, failing which the amount shall carry interest at the rate of 9% per annum from the date of default, till the date of deposit.

The parties have filed a Joint Memo in terms of their settlement. The settlement is in the best interest of the parties and therefore, accepted.

Accordingly, the Judgment and Award dated

07.07.2006 passed In MVC No.1584/2002 on the file of the III Additional Civil Judge (Sr. Dn.) and Additional MACT, Belgaum. stands modified in terms of the Joint Memo. The entire enhanced amount shall be released in favour of the appellant. Draw up the award in terms of the Joint Memo. Sd! JUDGE BMV’
