KAMAL - 2 - NC: 2024:KHC:31151 WP No. 23893 of 2021 ORAL ORDER Learned counsel for the petitioner after arguing the month for some time submits that since order impugned in this petition is passed by the 39th Additional Chief Metropolitan Magistrate, Bangalore under Section 14 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, petitioner would file appeal against the said order as provided under the Act. However, the petitioner seeks extension of interim order granted by this Court by order dated 23.12.2021.

Counsel for the petitioner further submits that the condition imposed by this Court for depositing 30% of the amount due has already been complied with and the same has not been disputed by the counsel for the respondent-Bank.

Interim protection granted by this Court is extended for a further period of eight weeks. The time consumed in prosecuting this matter be exempted for the purpose of consideration of the issue of limitation, if in the event of petitioner filing the appeal within 30 days from the date of receipt of the copy of this order.
