The Thbunal calculating loss of leave in terms of salary has rightly awarded one month salary amounting to Rs.5.690/-, towards loss of Income during treatment period. The same Is Just and proper and there is no scope for enhancement.
Claimant after sustaining Injuries has continued his employment and there is no loss of future income. Therefore. awarding compensation towards loss of future income does not arise.
Rs. 5,000/- awarded by the Tribunal towards loss of amenities. in the absence of evidence of the doctor regarding disability is Just and proper and there is no scope for enhancement tinder this head.
Thus the claImant Is entitled for the following compensation: Pain and suffering 1) 2) Medical expenses 3) 4) IncIdental expenses Towards loss of income during laid tip l)eriod Rs. Towards loss of amenities Rs. 5) Rs. 25.000/- Rs. 15,000/- Rs. 5,000/-
