Petitioner claims to have been allotted the Minor Mineral Block No. 7 from Pandit Stone Crusher to Pinjura Link Road D/Stream Ferozpora Nallah District Baramulla, and Block No. 19, Goigam Bridge to Magam Bridge, Downstream, in terms of NIT issued in the year 2019 after having been approved by the Mining Plan Approval Committee District, Baramulla in terms of Government Order Nos. DDK/DGM/MPA/BLA/F-04/82-86 dated 19.06.2020 and DDK/DGM/MPA/BLA/F-04/183-187 dated 6th October, 2020. It has been alleged that the respondents particularly Sub Divisional Magistrate, Tangmarg, have been creating hurdles and not allowing the petitioner to extract the minor minerals from the allotted block.
Heard. Issue notice to the respondents. Notice is accepted by Mr. Furqan Sofi, the learned Government Advocate behalf of all the respondents.
Learned counsel for the petitioner submits that the petitioner would be satisfied in case this petition is disposed of at this stage with a direction to the respondents not to create any hurdle in the extraction work in the block duly allotted to the petitioner in terms of the Government orders supra.
Learned Government Advocate appearing for the respondents has no serious objection to the petitioner’s plea.
Be that as it may, the petition in hand is disposed of with a direction to the respondents not to create any hurdle in the extraction of minor minerals in the block allotted to the petitioner, strictly in accordance with the terms and conditions of extraction order.
