Petitioner seeks a direction upon respondents to trace out whereabouts of his son, namely Aktar Huissain Khan. He also prays to direct respondents to finalize the ex-gratia case of petitioner if respondents fail to trace out whereabouts of his son and subsequently grant other benefits to dependents of petitioner under SRO 43 of 1994.
Status report has been filed by respondents 3 to 5, which is supported by an affidavit of Senior Superintendent of Police, Bandipora, wherein it is stated that as per the statement of witnesses/other evidence it has been found that the subject left home to cross LOC in connection with acquiring training of illegal arms/ammunitions via Gurez route and on reaching Machil Sector of Kupwara District heavy exchange of firing took place, and that it has not been confirmed whether subject crossed LOC or got killed in firing.
