JUSTICE WASIM SADIQ NARGAL, JUDGE O R D E R 02.03.2024 Heard Mr. Ishrat Maqbool Bhat, learned counsel for the petitioner. When this matter was taken up, it has been submitted by Mr. Ishrat Maqbool Bhat, learned counsel for the petitioner that he would like to withdraw this petition with liberty to approach the Bank for substitution of the current mortgage with an equivalent fresh mortgage. In view of the above submissions, we are of the view that the Bank can certainly consider such a request of the petitioner, if it aligns with the Bank’s objectives. In the event of making any such application by the petitioner or offering an equitable mortgage, the Bank shall consider the same in accordance with its own policies and norms.
