Sinha, Addl.P.P ------ ------ Order No.04 Dated- 13/10/2023 Heard the parties. The petitioner has been made accused in connection with Herhanj P.S. Case No.33 of 2023 registered under Section 379, 414, 34 of the Indian Penal Code, Section 21 of Mines and Minerals Development and Regulation Act, 1957 and Rule 13 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner is the driver of a tractor which was seized by police while being involved in transportation of illegally extracted coal. It is submitted that the allegation against the petitioner is false. It is further submitted that the petitioner has been in custody since 26.06.2023 which is evident from para-14 of the instant bail application. It is lastly submitted that the petitioner undertakes to co-operate with the trial of the case. Hence it is submitted that the petitioner be released on bail. Learned Addl.P.P appearing for the State opposes the prayer for bail of the petitioner. Considering the facts of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Latehar in connection with Herhanj P.S. Case No.33 of 2023 with the condition that he will co-operate with the trial of the case. Animesh/ (Anil Kumar Choudhary, J.)
